Court of Queen's Bench Justice Dennis Thomas has rejected a bid by Const. Leo Johnston's mother to block the move, arguing her son's remains should stay in the town where he was born and raised.

The constable was one of four Mounties gunned down by James Roszko during a stakeout on his property near Mayerthorpe, Alta., in March 2005.

The judge ruled it wasn't unreasonable for Alberta's vital statistics director to issue a permit to Kelly Johnston allowing her to have her husband's remains moved from a cemetery in Lac La Biche.

The mother, Grace Johnston, says she wants to discuss the judgment with her lawyer before making any comment.

Kelly Johnston and her lawyers were not immediately available, but the widow has previously said her actions were about "love and honour and respect.''
