The 'Mean Girls' actress spent an evening with The Wanted singer and his bandmates Jay McGuiness, 22, and Tom Parker, 24, at New York's Avenue club after their Madison Square Garden concert with Justin Bieber on Wednesday night.

Lindsay had set her sights on hooking up with Max, 24, and reportedly became "enraged" when she saw 28-year-old fortune teller Tiffany Mitchell talking to him.

An onlooker told the Daily Mirror newspaper: "The four of them - along with a friend of Lilo's (Lindsay Lohan) - were drinking before heading off to Avenue club together.

"Come 4am, Lilo seemed quite drunk and you could see it was turning Max off. He then began talking to another woman, which is believed to have enraged Lindsay."

Lindsay, 26, is also reported to have called Tiffany a "f***ing gypsy" because of her profession.

To which Tiffany's husband responded by saying: "We are not gypsies. That has nothing to do with our religion ... it was a racist comment.

"Just because your career went down the drain and your new movie sucks, you can't go around beating people up."

As she was lead out of the club by police following the scuffle, Lindsay was heard shouting: "Oh my God, I didn't touch anyone. Are you kidding me?"

The 'Liz & Dick' actress was taken into custody in the early hours of Thursday morning and booked for misdemeanour assault and she was also formally charged with lying to the police over her car accident in June just hours after the night club arrest.

According to TMZ.com, Max ended up leaving the club with a different girl.
